Terms of Service
Last updated: September 12, 2026
1. Purpose and Operator
SouverainCode (SvC) is a service operated by Archipel, a company registered in Lévis, Québec, reachable at [email protected] for any question. The service provides a coding assistant agent powered by several AI models, with smart routing that automatically picks the model best suited to each step of your request — nothing to configure on your end. By using the service, you agree to these terms.
2. Subscription
The service offers the following plans, each with a monthly request cap and a monthly compute envelope, both shown at all times in your settings (Settings → Usage):
- Discovery — free, 14 days, 50 requests, no card required.
- Solo — $25 CAD/month, 3,000 requests/month, Fast model.
- DEV — $129 CAD/month, 5,000 requests/month, smart multi-model routing (escalating up to the Deep model).
Paid plans are billed in advance via Stripe, in Canadian dollars; no GST or QST is added to the price shown. They are paid at sign-up: the plan opens only once payment is confirmed, and no free trial applies to them (the 7-day trial is the Discovery plan). A plan change mid-subscription is prorated by Stripe on the following invoice. Access remains active as long as the subscription is. Reasonable, non-automated use (see section 4) is still required to preserve service quality for all members. Reaching the monthly request cap incurs no extra charge: the service becomes available again when the period renews, or immediately by moving up to a higher plan. The same goes for the compute envelope: each plan includes a monthly compute capacity, shown as a percentage in your settings, which long missions or missions on the Deep model use up faster than short ones. Once reached, there is no extra charge either: missions resume when the period renews, or immediately with a higher plan.
Members already subscribed before this change of plans: if you were subscribed to the former single $50/month plan with unlimited use before the caps above were introduced, your access remains unlimited in number of requests as long as your subscription stays active without interruption — this change does not retroactively reduce what you already agreed to.
End of the Discovery trial: when the 14 days are up, the account is neither deleted nor emptied. Your conversations, workspace, agents and routines are kept; only new missions wait for you to choose a plan. You can export your workspace (Settings → Account) or delete your account at any time.
3. Account
You are responsible for keeping your credentials confidential. Only one active session per account is permitted: logging in on a second device closes the session on the first. Sharing an account may lead to suspension.
4. Acceptable Use and Bot Protection
You agree not to use the service for illegal, fraudulent, or harmful purposes, nor to automate sign-ups or logins via scripts (bots). The service applies rate limits on connections and missions, and traffic is filtered by a network-level protection against malicious bots before reaching our servers. Bypassing these protections may lead to account suspension.
5. Intellectual Property
Subject to third-party rights and the AI model's terms, the code generated belongs to you. You remain responsible for its use.
6. No Warranty, Availability
The service is provided "as is." The AI can produce errors: always review generated code before using it.
The online service comes with no availability commitment: maintenance windows (updates, restarts) may briefly interrupt it, and an outage remains possible. In that case, your data stays in place (daily backup, see the privacy policy) and the service resumes without any action on your part. No compensation is owed for an interruption, without prejudice to your rights under the law.
7. Limitation of Liability
To the extent permitted by law, SouverainCode cannot be held liable for indirect damages arising from the use of the service.
8. Termination
We may suspend or terminate an account for non-compliance with these terms or non-payment.
You may cancel your subscription at any time from the billing portal (Settings → Subscription). Cancellation takes effect at the end of the current billing period — access remains active until then, and no prorated refund is offered for the period already underway. This policy does not limit your rights under Québec's Consumer Protection Act, notably if the service has a defect that prevents you from normally benefiting from it.
9. SouverainBox (on-premises machine)
Purpose. The SouverainBox is a machine prepared by Archipel (a manufacturer's workstation with SouverainCode and models preinstalled), bought in a single payment via Stripe at the final price in Canadian dollars shown on the quote. A SouverainCode account is required to place and track the order.
Ownership. The machine belongs to you upon delivery. The open-source software it contains remains governed by its licences; SouverainCode is installed on it for your organization's internal use, with no time limit. The box needs no Archipel service to run: it keeps working offline, including if Archipel ceased operations (without updates in that case).
Delivery. Canada only, after configuration, usually one to two weeks after payment. Archipel contacts you before shipping; delivery fees, if any, appear on the quote.
Cancellation and return. Before shipping, you may cancel the order in writing: the amount paid is refunded to you. After delivery, the hardware is covered by the manufacturer's warranty; any other return is agreed in writing with Archipel. Your rights under the Consumer Protection Act remain.
Warranty. The hardware is covered by the manufacturer's warranty, whose duration is shown on the quote (3-year HP warranty on Z2 Mini workstations). For the software, Archipel fixes the SouverainCode defects reported to it; section 6 applies to the AI's answers. In case of a hardware failure under warranty, the manufacturer repairs or replaces the machine; Archipel reinstalls SouverainCode on a repaired machine as part of maintenance.
Maintenance (monthly option). Maintenance includes SouverainCode and model updates, remote checks and support. It is cancelled like a subscription (section 8). Without maintenance, the box keeps working as is.
Remote support. Support access is closed by default. It only opens through an administrator of the box, from Settings, after explicit consent, for 1, 4 or 24 hours; it closes on its own when the time is up and at every reboot, and every opening is recorded in the box's log, which never leaves it. Details are in the privacy policy.
10. Governing Law
These terms are governed by the laws of Québec and Canada.
